2. Scope of these Terms
These Terms apply to the public Nikufra.ai website, our legal pages, demo requests, commercial communications, and any non-contractual use of our website. If you are a customer with a signed agreement, order form, statement of work, master services agreement, or similar contract with Nikufra, that signed agreement controls where it conflicts with these Terms.
The Nikufra.ai website is intended for business and professional users, especially manufacturing companies, operations leaders, engineering teams, and industrial decision makers.
3. Website use
You may use the website to learn about Nikufra, request information, book or request a demo, and contact us. You must not misuse the website, interfere with its operation, attempt unauthorized access, probe or scan systems without permission, upload malicious content, or use the website in a way that violates applicable law or the rights of others.
- Do not attempt to access non-public systems, source code, credentials, customer environments, or infrastructure.
- Do not use automated scraping or high-volume requests that degrade the website or its hosting infrastructure.
- Do not submit unlawful, confidential third-party, misleading, or malicious content through contact channels.
- Do not impersonate another person or organization.
4. Services and demos
Information on the website describes our capabilities at a general level. It is not a binding offer, specification, service level agreement, warranty, or guarantee of a particular result. Any project, pilot, implementation, on-premises deployment, or support arrangement must be agreed in a separate written agreement.
Where we provide demos or commercial materials, they may use representative examples, public information, simulated data, or customer-approved information. We do not claim to have analyzed a specific company or factory unless we have been given authorized access to relevant data by that company.
5. Customer data and industrial data
Customers retain ownership of their data, including factory, operational, production, maintenance, planning, quality, ERP, MES, SCADA, PLC, WMS, and similar industrial data. Nikufra does not acquire ownership of customer data by providing services.
Where Nikufra is given access to customer systems or data, that access must be authorized by the customer and governed by the applicable customer agreement. Access may be remote or on-site depending on the agreed project and customer environment.
Unless expressly agreed in writing, Nikufra does not use customer production data to train general-purpose models or unrelated third-party products.
6. AI outputs and human control
Nikufra builds analytical, predictive, and AI-assisted tools for manufacturing operations. Outputs generated by those tools are intended to support human analysis and operational decision-making. They should not be treated as autonomous instructions for safety-critical, legal, financial, employment, or high-risk decisions unless a specific contract, validation process, and governance model have been agreed.
Customers are responsible for reviewing outputs, validating proposed actions, and deciding whether and how to act on them in their production environment.
7. Intellectual property
The website, brand assets, text, visual systems, software concepts, code, interfaces, documentation, methods, and other materials made available by Nikufra are owned by Nikufra or its licensors, except where otherwise stated. You may not copy, modify, distribute, reverse engineer, or commercially exploit them without permission.
Feedback, suggestions, or ideas you provide may be used by Nikufra to improve our website, services, and products, without creating an obligation to compensate you, unless separately agreed in writing.
8. Third-party services
Our website and business operations may rely on third-party service providers such as hosting, analytics, email, and scheduling providers. These providers are described in our Privacy Notice and Subprocessors page where relevant. If you follow a link to, or interact with an embedded service from, a third-party provider, that provider's own terms and privacy notices also apply.
9. Disclaimers
The website is provided on an "as is" and "as available" basis. We aim to keep information accurate and useful, but we do not guarantee that the website will always be uninterrupted, error-free, secure, or complete.
Website content is informational and should not be relied on as technical, legal, financial, safety, or operational advice for a specific factory or company without a separate assessment.
10. Limitation of liability
To the maximum extent permitted by applicable law, Nikufra will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or reliance on general website information. Nothing in these Terms limits liability that cannot legally be limited.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date indicates when the latest version was published. Material changes will be reflected on this page.
12. Governing law and contact
These Terms are governed by the laws of Portugal, unless mandatory law provides otherwise. For questions about these Terms, contact us at hello@nikufra.ai.
